Two-day training on State aid rules and principles for infrastructure projects in the areas of: local infrastructures, transport, waste, energy and environment, culture and sports, and R&D&I. With a special focus on the projects co-financed by ESI Funds.

Challenges for the Authorities Involved

Investments from European Structural and Investment Funds (ESIF) have to comply with EU State aid regulations. All officials dealing with EU-funded projects representing both the managing bodies and the beneficiaries - must be aware of the related procedures and prevent infringements.

This concerns in particular the infrastructure projects which usually require a substantial amount of funding and do not qualify as de minimis aid. The new interpretation of the “economic activity” criterion resulting from the Leipzig-Halle Judgement , together with the new set of State aid rules for various sectors, have made the funding of infrastructure even more complicated.


Programme Overview

The training presents the general principles of State aid and horizontal regulations applicable to all sectors:

Session I: General Principles and Rules Applicable to Funding of Infrastructure
Session II: Assessing the Existence and Proportionality of Aid for Infrastructure Projects
Session III: General Block Exemption Regulation
Session IV: Regional Aid Guidelines
Session V: Funding Infrastructure as Services of General Economic Interest

A special focus will be given to the examples of infrastructures in sectors such as:

Session VI: Energy and Environment
Session VII: Ports and Airports
Session VIII: R&D&I

The programme will be completed by a problem solving & discussion session, giving the participants the opportunity to present their own problems and cases and discuss them with our experts and other participants.


Methodology

The Lexxion Training Method combines the three stages of learning to ensure that the participants obtain the best possible understanding of EU rules:

1) Identification of the main points or principles;
2) Appreciation of the complexities and limitation of the principles, and
3) Application of the principles.

The participants will be actively involved in the training and will analyse several State aid rules on the basis of real cases. The training’s sessions will combine presentations with case studies and practical exercises in working groups. Moreover, each session will give the participants enough opportunities to present their own problematic issues and discuss them with the speakers and participants from other Member States. For this end, cases and questions can be sent to us beforehand.
